TERMS OF SERVICE

These Terms of Service govern the use of the Nash Print Studio by Shamus & Co. website and the purchase of products and services from our business.

By visiting our website, submitting artwork, placing an order, or purchasing a product or service, you agree to these Terms of Service.

1. OUR PRODUCTS & SERVICES

Nash Print Studio by Shamus & Co. provides products and services that may include:

  • DTF transfers

  • Custom gang sheets

  • Custom apparel

  • Personalized products

  • Signs and decals

  • Business printing

  • Specialty printed products

  • Other custom printing and design services

Because many products are created specifically for each customer, additional conditions may apply to custom and personalized orders.

2. CUSTOM ORDERS

Customers are responsible for reviewing all order details before submitting an order, including:

  • Artwork

  • Spelling

  • Names and numbers

  • Dimensions

  • Transfer sizes

  • Garment sizes and colors

  • Quantities

  • Print placement

  • Personalization

  • Shipping information

Once production has started, a custom order generally cannot be changed or canceled.

Changes requested after production begins may require additional charges or a new order.

3. CUSTOMER-SUPPLIED ARTWORK

Customers are responsible for the quality and accuracy of artwork submitted for printing.

For best results, artwork should meet the file and resolution requirements provided on our website.

Low-resolution, blurry, pixelated, improperly sized, or otherwise poor-quality artwork may affect the finished product.

We are not responsible for printing problems that result directly from the quality or specifications of customer-supplied artwork.

4. COPYRIGHT & ARTWORK AUTHORIZATION

By uploading or submitting artwork, logos, photographs, graphics, trademarks, text, or other content, you represent that you own the content or have permission and legal authority to use and reproduce it.

You also authorize Nash Print Studio by Shamus & Co. to reproduce the submitted content solely as necessary to fulfill your order.

We reserve the right to refuse an order when we reasonably believe the submitted material may violate intellectual-property rights or applicable law.

The customer is responsible for claims arising from content the customer did not have authorization to reproduce, to the extent permitted by applicable law.

5. ARTWORK COLORS & PRINT RESULTS

Colors displayed on phones, tablets, monitors, and other digital screens may differ from the final printed product.

Differences can occur because of screen settings, garment colors, materials, printing processes, inks, transfer films, and other production factors.

Exact screen-to-print color matching is not guaranteed unless specifically agreed upon before production.

6. DTF TRANSFERS & APPLICATION

Customers purchasing ready-to-press DTF transfers are responsible for applying the transfers correctly.

Pressing instructions are provided as general guidance. Heat presses, fabrics, garments, and environmental conditions can vary.

Customers should verify appropriate temperature, pressure, pressing time, peeling method, and fabric compatibility before production use.

We are not responsible for damage caused by improper application, excessive heat, incorrect pressure, incorrect pressing time, unsuitable fabrics, or failure to follow applicable pressing instructions.

Testing a transfer when working with an unfamiliar garment or material is strongly recommended.

7. PRICING & PAYMENT

Prices may change without notice.

Payment must be received according to the terms presented during checkout or on an applicable invoice before an order is produced unless other arrangements have been made.

We reserve the right to correct obvious pricing, product-description, discount, or website errors.

If an error materially affects an order that has already been submitted, we may contact the customer before proceeding and provide appropriate options.

8. PRODUCTION & TURNAROUND TIMES

Turnaround estimates are estimates and are not guaranteed delivery dates unless specifically stated otherwise in writing.

Production time generally begins after required payment, artwork, customization information, and order details have been received.

Orders requiring artwork corrections, customer approval, additional information, or special-order materials may take longer.

Rush services, when available, affect production priority and do not guarantee a shipping carrier's delivery time.

9. SHIPPING

Shipping estimates provided during checkout are carrier estimates unless expressly stated otherwise.

Once an order has been transferred to a shipping carrier, delays caused by weather, carrier operations, transportation disruptions, or other circumstances outside our reasonable control may affect delivery.

Customers are responsible for providing a complete and accurate delivery address.

10. LOCAL PICKUP

Local pickup may be available for qualifying orders.

Customers should wait until they receive confirmation that an order is ready before attempting pickup.

Pickup availability and instructions may vary by order.

11. RETURNS, REFUNDS & CUSTOM PRODUCTS

Returns and refunds are governed by our Refund Policy.

Because custom and personalized products are produced specifically for an individual customer, many custom products are not eligible for return because of a change of mind, incorrect size selection, customer-supplied artwork error, or other customer selection error.

Nothing in these Terms limits rights that cannot legally be excluded under applicable consumer-protection law.

12. ORDER CANCELLATIONS

Contact us as quickly as possible if you need to cancel an order.

Orders that have not entered production may be eligible for cancellation.

Once custom materials have been ordered, artwork preparation has begun, or production has started, cancellation may not be possible or certain incurred costs may be non-refundable where permitted by law.

13. PRODUCT AVAILABILITY

Products, garment colors, sizes, brands, materials, and other inventory are subject to availability.

If an item becomes unavailable after an order is placed, we may contact you regarding an appropriate substitute, backorder, modification, or refund for the unavailable portion of the order.

We will not substitute a materially different product without appropriate customer approval.

14. WEBSITE USE

You may not use our website or services to:

  • Violate applicable laws

  • Infringe intellectual-property rights

  • Submit fraudulent orders

  • Introduce malicious software or code

  • Interfere with the operation or security of the website

  • Misrepresent your identity or authorization to use submitted content

We reserve the right to refuse service or cancel transactions where reasonably necessary to address fraud, abuse, unlawful activity, or violations of these Terms.

15. THIRD-PARTY SERVICES

Our store may use third-party services such as Shopify, payment processors, shipping carriers, applications, and other technology providers.

Use of those services may also be subject to the applicable provider's terms and policies.

16. LIMITATION OF LIABILITY

To the fullest extent permitted by applicable law, Nash Print Studio by Shamus & Co. will not be liable for indirect, incidental, special, or consequential losses arising from use of our products, services, or website.

Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited.

17. PRIVACY

Personal information collected through our website is handled according to our Privacy Policy and applicable privacy requirements.

18. CHANGES TO THESE TERMS

We may update these Terms of Service periodically.

The version posted on our website at the time of use will govern unless applicable law requires otherwise.

19. GOVERNING LAW

These Terms are governed by applicable United States law and the laws of the state in which Nash Print Studio by Shamus & Co. operates, without limiting any mandatory consumer rights that may apply.
